Changes to the Terms
If we believe that the changes are material, we’ll definitely let you know by doing one (or more) of the following: (1) posting the changes through the website or (2) sending you an email or message about the changes. That way you can decide whether you want to continue using the Services. Changes will be effective upon the posting of the changes. You are responsible for reviewing and becoming familiar with any changes.
TSF connects fair trade consumers around the world with our cooperative members. This site is inclusive and is designed to encourage comradery between all those represented on the site and all those interested in sharing it. We want everyone on TSF to feel welcome, and building an inclusive environment is our priority.
It is your responsibility as a seller or buyer to know your local laws and any other legal regulations on discrimination that might apply to you. Discrimination is not allowed. Examples of prohibited behavior on TSF include, but are not limited to:
- Refusal of service based on membership in one or more protected group
- Derogatory or demeaning remarks against any group listed above
- Racial or cultural slurs
- Posts that support or glorify any hate groups, past or present
If you think discrimination has occurred on TSF, please report it by e-mailing email@example.com and we will investigate. If you see a listing on TSF which you believe violates TSF ‘s Prohibited Items Policy, we encourage you to email firstname.lastname@example.org and report the item.
You agree to act responsibly at this site and to treat other members/visitors with respect. You agree not to use this site to harass, harm, or abuse other people directly or indirectly through information obtained from this site.
TSF complies with the Children’s Online Privacy Protection Act. To ensure that we do not collect personally identifying information from children under the age of 13, TSF’s policy does not allow persons under the age of 13 to shop or buy from TSF.
Disputes with Other Users
If you find yourself in a dispute with another user of TSF’s Services or a third party, we encourage you to contact the other party and try to resolve the dispute amicably.
Release of TSF
You release TSF from any claims, demands, and damages arising out of disputes with other users or parties.
Disputes with TSF
If you’re upset with us, let us know and hopefully, we can resolve your issue. But if we can’t, then these rules will govern any legal dispute involving our Services:
A. Governing Law. The Terms are governed by the laws of the State of Washington, without regard to its conflict of laws rules, and the laws of the United States of America. These laws will apply no matter where in the world you live, but if you live outside of the United States, you may be entitled to the protection of the mandatory consumer protection provisions of your local consumer protection.
B. Mediation. In the event of any dispute arising under this agreement, the matter shall be submitted to mediation, conducted in Port Angeles, Washington. The terms and procedure for mediation shall be arranged by the parties to the dispute. Mediation costs will be paid by party seeking mediation.
C. Right to Bring Action. Notwithstanding the foregoing, each party shall have the right to bring an action in a court of proper jurisdiction for injunctive or other equitable or conservatory relief, after a good faith attempt at mediation. You may instead assert your claim in “small claims” court, but only if your claim qualifies, your claim remains in such court, and your claim remains on an individual, non-representative, and non-class basis. You explicitly waive your right to bring a class-action lawsuit against TSF or any of its members.
D. Forum. We’re based in Port Angeles, Washington, so any legal action against TSF related to our Services must be filed and take place in Port Angeles or Clallam County. That means the seat of any mediation shall be Port Angeles. For any actions not resolved by mediation, you and TSF agree to submit to the personal jurisdiction of a state court located in Olympia or Port Angeles, Washington.
As Is Site
Although TSF will make reasonable efforts to ensure the accuracy of the site, this may not always be possible. TSF is dedicated to making our Services the best they can be, but we’re not perfect and sometimes things can go wrong. You understand that our services are provided “as is” and without any kind of warranty (express or implied). We are expressly disclaiming any warranties of title, non-infringement, merchantability, and fitness for a particular purpose, as well as any warranties implied by a course of performance, course of dealing, or usage of trade.
We do NOT guarantee that:
- The Services will be secure or available at any particular time or location
- Any defects or errors will be corrected
- The Services will be free of viruses or other harmful materials
- The results of using the Services will meet your expectations
You use the Services solely at your own risk. Some jurisdictions do not allow limitations on implied warranties, so the above limitations may not apply to you.
Everything on the Site is provided to you “AS AVAILABLE” AND “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NEITHER WE NOR ANY OTHER PERSON OR ENTITY PROVIDING CONTENT VIA THIS SITE SHALL BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THIS SITE OR THE INFORMATION PROVIDED BY THIS SITE.
People You Interact With
You can use the Services to interact with other individuals, either online or in person. However, you understand that we do not screen users of our services, and you release us from all liability relating to your interactions with other users. Please be careful and exercise caution and good judgment in all interactions with others, especially if you are meeting someone in person.
To the fullest extent permitted by law, neither TSF, nor our employees or directors shall be liable to you for any lost profits or revenues, or for any consequential, incidental, indirect, special, or punitive damages arising out of or in connection with the services or these terms. In no event shall TSF’s aggregate liability for any damages exceed the greater of one hundred ($100) US Dollars or the amount you paid TSF in the past twelve months. Some jurisdictions do not allow limitations on incidental or consequential damages, so the above limitations may not apply to you.
This is not something we hope to experience, but if TSF gets sued because of something that you did, you agree to defend and indemnify us. That means you’ll defend TSF (including any of our employees) and hold us harmless from any legal claim or demand (including reasonable attorney’s fees) that arises from your actions, your use (or misuse) of our Services, your breach of the terms, or your account’s infringement of someone else’s rights.
We reserve the right to handle our legal defense however we see fit, even if you are indemnifying us, in which case you agree to cooperate with us so we can execute our strategy.
The terms, including all of the policies that make up the terms, supersede any other agreement between you and TSF regarding the services. If any part of the terms is found to be unenforceable, that part will be limited to the minimum extent necessary so that the terms will otherwise remain in full force and effect. Our failure to enforce any part of the terms is not a waiver of our right to later enforce that or any other part of the terms.
